Privacy Policy

Effective Date: May 17th, 2016

In this Privacy Policy, we (CASTMATE, INC, a Delaware Corporation (“CASTMATE” or “we”)), describe how we use personally identifiable information about you that we collect through webpages at CASTMATE (such website being the “Website”). CASTMATE is strongly committed to protecting your privacy and providing a safe online experience for all our users. When you register for an account for the services (the “Services”) provided by CASTMATE or at any later time, or if you otherwise use CASTMATE Services you may provide to CASTMATE what is generally called “personally identifiable information” or “PII” (such as your name, password, age, gender, email address, postal mailing address, zip code, and home/mobile telephone number). If you choose to provide such information, during registration or otherwise, you are giving CASTMATE permission to use and store it consistent with this Privacy Policy.

Please read the complete Privacy Policy below and contact us if you have any questions. This Privacy Policy is part of and incorporated into the User Agreement of the Website (the “User Agreement”). Accordingly, and per the User Agreement, CASTMATE may make changes to the Privacy Policy from time to time in its sole discretion by updating this posting on the Website, and specifying the effective date of the new version of the Privacy Policy. Your continued use of the Website following the posting of a new version of the Privacy Policy constitutes your acceptance of any such changes. Accordingly, whenever you visit the Website you should check to see if a new version of the Privacy Policy has been posted.

If you are not comfortable with this Privacy Policy or the User Agreement, please do not provide us with PII or otherwise use the Website.

1. Types of Data Collected; Collection Methods; Combination of Data

You actively send information to us when you create an account for or use the Services, respond to us or otherwise contact us. Depending on your choices, you may send us PII such as your email address, name, mailing address, phone number, birthday, and gender. In addition, you may provide us with information necessary for CASTMATE to collect the fees owed it in respect of providing the Services. We also may track information about how our Website is used by you through cookies, Internet tags and navigational data collection. For example, your Internet browser automatically transmits to us information such as the URL of the website you just came from and the Internet Protocol (IP) address and the browser version your computer is currently using.

In addition, we may participate in ad networks. Such ad networks may collect anonymous information using cookies to target some of the advertising you see on the Website and on other third party websites. You can set your browser to notify you when a cookie is sent or to refuse or delete cookies altogether, but certain features of the Website might not work without certain cookies.

Cookies. Like many websites, we may use “cookies”. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your Web browser to enable our systems to recognize your browser. We may use persistent, identifying cookies to remember your information and to link your activities to you. CASTMATE may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Website. Persistent cookies can be removed. While you can take steps to block or disable cookies, if you do the Website may not function and appear as we intend it. Nonetheless, if you want to take these steps you can do so by following the instructions associated with your browser.

“Automatically Collected” Information. When you access or use the Website or any other part of the Services, CASTMATE’s servers may automatically record certain information from your browser by using different types of technology, including standard log files, “clear gifs” or “web beacons.” Such “server logs” may include your Internet Protocol (IP) address, browser type, internet service provider (ISP), referring or exit pages, click stream data, operating system and the dates and times that you visit the Website. Additionally, CASTMATE may record certain information regarding your use of features CASTMATE may make available on or through the Website, such as the services you have used or options you have chosen in the past.

Collection of Information by Third Parties. Our Website may include third-party advertising, links to other websites, and other content from third party businesses. We do not provide any PII to these advertisers, third-party websites, or other businesses, although on occasion we may mutually share non-personally identifiable (e.g. demographic) information to facilitate delivery of advertisements. These third-party websites, businesses, and advertisers, or advertising companies working on their behalf, sometimes use technology to deliver the advertisements that appear on our Website directly to your browser. They automatically receive your IP address when this happens. They may also use cookies, JavaScript, and other technologies to measure the effectiveness of their ads and to personalize or optimize advertising content. We do not have access to or control over cookies or other technologies that they may use, and the information practices of these advertisers and third-party websites or businesses are not covered by this Privacy Policy but are covered by their respective privacy policies.

Your communications. When you send email or other communications to CASTMATE, CASTMATE may retain such email or other communications and collect information associated with such email or other communications such as the content, date and time of such messages.

Information from Other Sources. CASTMATE may also obtain information, including personally identifiable information, from third parties and sources other than the Services. If CASTMATE combines or associates information from other sources with personally identifiable information that it collects through the Services, it will treat the combined information as personally identifiable information in accordance with this Privacy Policy.

2. Purpose of Data Collection

Use of PII. CASTMATE uses the information that you provide or that it collects in order to establish and enhance its relationship with you. CASTMATE generally uses such information to operate, maintain, enhance, and provide all of the features and services found on the Services. We may use your PII for purposes such as responding to your requests, maintaining your account, providing you with advertising, enforcing our rights, and investigating and ensuring compliance with the User Agreement. In addition, we may use data to create statistics and reports where personally identifiable information has been removed and aggregated.

CASTMATE may use “cookies” information to: (a) remember some of your information so that you will not have to re-enter it during your visit or the next time you visit the Website or otherwise use the Services; (b) provide customized third-party advertisements, content, and information; and (c) monitor aggregate site usage metrics such as total number of visitors and pages viewed.

CASTMATE’s employees, agents and contractors must have a legitimate business reason to obtain access to the personally identifiable information you may provide to register as a member of CASTMATE or use the Services. We may share your personally identifiable information with companies that provide services to us, including outside contractors or agents who help us manage our information activities, but they may only use your personally identifiable information to provide us with a specific service and not for any other purpose.

Use of Other Information. We may use non-PII about our users for purposes such as measuring the number of visitors to sections of our Website, making the Website more useful and delivering advertising. We may use IP addresses to analyze trends, administer the Website, track a user’s movement, and gather broad demographic information for aggregate, non-personally identifiable use.

Retention of Information. We retain information for as long as required, allowed or we believe it useful, but we do not undertake retention obligations. We may dispose of information in our discretion without notice, subject to applicable law that specifically requires the handling or retention of information.

3. Disclosure of Data

We may share information with third parties, but only as described in this Section 3.

Advertisers and Others. We may share non-personally identifiable information with advertisers, service providers, and other persons with whom we conduct business. Similarly, these advertisers, service providers, and other persons may share with us non-PII about you that they have independently gathered or acquired.

Third Party Services. We may contract with third parties to provide services to us or to you on our behalf. Examples may include providing customer service, sending emails to you, and analyzing data. These third parties may have access to your PII, but will be required to use this information solely in connection with these authorized business activities.

Business Transfer. As we develop our business we might sell or buy businesses or their assets, or engage in transfers, acquisitions, mergers, restructurings, changes of control or similar transactions. In such transactions, customer information generally is one of the transferred business assets, and your PII may be subject to such a transfer. Also, in the unlikely event of a bankruptcy, PII may be transferred to a bankruptcy trustee or debtor in possession and then to a subsequent purchaser.

Compliance and Safety. We may release user information when we believe release is appropriate or necessary to:

-comply with applicable law, and to respond to legal requests and to respond to or otherwise address written complaints of copyright infringement;

-make disclosures under programs intended to prevent potential crimes or investigate persons;

-enforce agreements, including the Users Agreement; or

-protect the rights, property, or safety of our Website and Services, our users, or others, including exchanging information with other companies for fraud protection.

CASTMATE also reserves the right to disclose user information that it believes, in good faith, is appropriate or necessary to take precautions against liability; to protect CASTMATE from fraudulent, abusive, or unlawful uses; to investigate and defend ourselves against any third party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Services; or to protect the rights, property, or personal safety of CASTMATE, its users, or others.

4. How Secure Is My Information?

Your Obligations. You must protect against unauthorized access to your password and to your computer. Please sign off when you have finished using a shared computer. Your emails to us are not necessarily secure against interception so do not include sensitive information in them. We will not ask for passwords in an email and you should assume that if you get such a request, it might be fraudulent. YOU MUST DO WHAT YOU REASONABLY CAN TO ENSURE THE SECURITY OF YOUR PERSONAL INFORMATION.

Our Security Measures. We take reasonable precautions to protect the security of our users’ information. We have physical, electronic, and managerial procedures to help safeguard and prevent unauthorized access, maintain data security, and correctly use your information. However, neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. Therefore, while we use reasonable efforts to protect your PII, we cannot guarantee its absolute security.

Third Party Websites. You should consult the respective privacy policies of these third-party websites and third party ad servers or ad networks. CASTMATE’s Privacy Policy does not apply to, and CASTMATE cannot control the activities of, such other third party advertisers or web sites.

If CASTMATE learns of a security systems breach, then it may attempt to notify you electronically so that you can take appropriate protective steps. CASTMATE may post a notice on the Website if a security breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

5. Your Choices

You may, of course, decline to share any or all of your personally identifiable information with CASTMATE, in which case CASTMATE may not be able to provide to you some of the features and functionality found on or through the Services. If you register for an account with CASTMATE you may update, correct, or delete your profile information and preferences at any time. To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. However, you are responsible for maintaining the secrecy of your unique password and account information at all times.
